Until the child reaches the age of 14 years, his/her legal representative shall decide on matters concerning membership and on the utilization of Bonus Points. Between the age of 14 and 18 years, to be considered valid the declaration of the minor requires the consent or the subsequent approval of the legal representative of the minor. All such communication shall be submitted in writing.
II. Acceptance, authorization
II/1. The person intending to participate in the Malév Duna Club Frequent Flyer Programme, that is the person intending to join the Malév Duna Club, by completing the Application Form, expressly declares that he/she is fully aware of the terms and conditions contained in the Application Form and in the current Regulation, accepts these and considers them binding on him/her. The expression "commercial partner" as used in the current Regulation shall be understood to mean a third party associated with the Malév Duna Club Frequent Flyer Programme through its service on the basis of a contractual relationship.
II/5. Each member of Malév Duna Club shall receive an individual frequent flyer identification code, which allows members to be differentiated even when members bear identical names.
The personalized frequent flyer card corresponding to the Malév Duna Club membership tier shall indicate the name of the holder and the frequent flyer identification code; premium tier cards also indicate the date of expiry of the card.
II/6. Each Malév Duna Club member shall have only one frequent flyer identification code, data file and database at any one time; the Bonus and Club Points of only one Malév Duna Club member may be credited under a given identification code.
II/7. Plastic frequent flyer cards certifying club membership shall be issued to frequent flyers holding Blue, Silver, Gold or Platinum tier status. Frequent flyers holding Basic tier status shall be issued with a paper-based frequent flyer card, unless Malév and its business partners agree otherwise.
II/8. The frequent flyer card certifying the club membership of the Malév Duna Club member shall remain the property of Malév. This card must be returned to the address of the Malév Service Center without specific notice to this effect, or must be destroyed, upon the termination of membership (the same rule applies to the previous card upon receiving a new card issued when changing tiers). The member who is reclassified or has his/her membership withdrawn undertakes to return his/her card to Malév, or to destroy it, without specific notice to this effect, within 15 days of receiving notice of such.
II/9. The Malév Duna Club member shall be entitled to authorize - in writing, with a declaration in a private document providing full evidence, or in a notorial document - other natural persons of legal age to proceed on his/her behalf regarding Malév Duna Club matters (e.g. collection of airline tickets).

e) the issuer of the electronic document has placed his/her qualified electronic signature on the electronic document.
II/10. Malév may exclusively manage the personal data provided by the Duna Club member under this chapter in connection with performing its services and pursuant to those conditions stated in point II/4., as well as in compliance with the data protection provisions of prevailing laws.

III/2. Members of the Malév Duna Club Frequent Flyer Programme shall be admitted to the Blue, Silver, Gold, or Platinum tiers, depending on the number of valid Club Points collected, as indicated by the chart in the above point III/1. Taking the interests of the company into consideration, Malév may deviate from this provision.
III/3. Malév Duna Club members without any Club Points are placed in the Basic tier.
III/4. The member shall receive the services offered in the Malév Duna Club membership tier the member has achieved until the expiry of validity of his/her frequent flyer card.
IV. Points accrual, points crediting
IV/1. The points of the registered Malév Duna Club member shall be automatically credited if, at the time of booking the seat, collecting the ticket or during airport check-in, the frequent flyer presents his/her frequent flyer card or confirms his/her frequent flyer code. Inasmuch as the Malév Duna Club member does not fulfil the above conditions, Malév shall bear no liability whatsoever for failing to credit points.
Malév is entitled to decide that in the case of certain airlines, flights or business partners only Bonus Points shall be accrued.
IV/2. The basic units of the Malév Duna Club Frequent Flyer Programme are the Bonus Point and the Club Point.
- In principle, Bonus Points collected by travelling are valid for 3 years from the date of the trip (rounded up to the nearest quarter).
- In principle, Bonus Points collected on services provided by the business partners of Malév are valid for 3 years from the date of the crediting (rounded up to the nearest quarter).
- In the instance of fulfilment of conditions announced separately by Malév, the term of validity of Bonus Points may differ from the above.
- Club Points are valid for 1 year from the date of crediting and are automatically deleted at the end of this period.
- Club Points may be collected exclusively on Malév flights and on scheduled flights operated by member airlines of the oneworld alliance.
- Club Points shall not be collected on flights of non-oneworld member airlines or on services provided by the business partners of Malév.
Upon expiry of the deadlines determined in this section, the relevant rights shall be forfeited.
IV/3. Bonus Points and Club Points are registered separately and may not be combined.
IV/4. An identical number of Bonus Points and Club Points shall be credited to the account of the frequent flyer after each completed trip, with the exception of Bonus Point promotional campaigns.
IV/5. Bonus Points and Club Points are calculated as follows.
In the case of points accrued on completed flights of Malév and its partner airlines:
Multiply the number of 'base points' by the 'tier multiplier', and then multiply this by the 'class multiplier'. The points thus calculated are credited to the account of the frequent flyer (Bonus account and Club account).
The number of base points accruable on completion of a given flight is published in a separate notice by Malév. The following tables show the tier multipliers and class multipliers.

IV/6. Furthermore, Bonus Points may also be generated through special points collection promotions advertised by Malév.
IV/7. Points awarded on grounds other than travel shall be credited exclusively as Bonus Points and shall not increase the Club Points account of the member.
IV/8. Points awarded in promotions shall be credited as Bonus Points and/or Club Points, depending on the terms of the promotion.
IV/9. No tier multipliers or class multipliers shall be applied on promotional Bonus Points and on Bonus Points awarded on grounds other than travel.
IV/10. Within the framework of the Malév Duna Club Frequent Flyer Programme, no Bonus Points, respectively Club Points, shall be credited for tickets issued for flights of Malév or its partner airlines, or on the services of commercial partners, if the points accruable on this basis were already credited to the frequent flyer in the framework of a different loyalty programme, or if the frequent flyer wishes to have those points credited at a later date.
Points already credited in the Duna Club frequent flyer programme shall not be retrospectively credited in the frequent flyer programme of a partner airline. Inasmuch as the Malév Duna Club member breaches this regulation, Malév shall be entitled to deduct the already credited points from the account of the frequent flyer.
IV/11. Regarding the points credited on code share flights operated by Malév and other airlines, the two-letter airline code indicated in the 'Carrier' column of the passenger's air ticket shall be applicable, unless Malév decides otherwise.
IV/12. Malév reserves the right to offer Malév Duna Club members additional benefits (beyond those established by the current Regulation) of a promotional nature; furthermore, to amend the charts indicating the points accruable on flights or the points required for Bonus tickets, or the tier multipliers.
IV/13. Malév and its airline or business partners may mutually decide to announce promotional opportunities to collect extra Bonus Points and/or Club Points at any time.
IV/14. Malév reserves the right to replace the current points system with a system based on miles at a later date.
IV/15. Bonus Points and Club Points shall also be credited on trips taken on Malév charter flights, where the MA code is indicated under the 'Carrier' column of the ticket. In the instance of trips taken on Malév charter flights, the Bonus Points and Club Points accruable on trips taken on discounted Economy Class shall be credited to the account of the passenger, irrespective of the actual travel class.
IV/16. If the Malév Duna Club member notices that his/her Bonus Points or Club Points have been miscalculated or have not been registered at all for reasons beyond his/her control, the member can request in writing that the points be credited retroactively. Such request shall be sent to the Malév Service Center by mail, fax, e-mail or in person, accompanied by the airline ticket and boarding card(s) of the flight in question; in the case of commercial partners, by submitting the other documents specified separately, under the applicable conditions, or via the Malév website page designated for this purpose, under the applicable conditions. Points may be credited retroactively within 1 year from the date of the flight, respectively from the date of the service provided by the commercial partner, unless Malév decides otherwise. Upon expiry of this deadline all rights shall be forfeited, without recourse to appeal.
Malév shall credit the Bonus Points, respectively Club Points retroactively within six weeks of receipt of the request and all the abovementioned documents.
IV/17. Bonus Points and Club Points shall only be credited on tickets actually used. No points shall be credited on the basis of tickets purchased but not used.
IV/18. Bonus Points and Club Points shall not be credited if, due to circumstances beyond the airline's control (in particular, but not exclusively, strikes, weather conditions, any reason connected to air traffic control, technical problems etc.), or due to security considerations, the flight is cancelled and/or the passenger uses his/her ticket on the flight of another airline. If the passenger travels on a route different from the one indicated by the ticket and/or on the flight of another airline due to the fault of Malév (for example, overbooking), then the number of points for the original route as appearing in the original ticket shall be awarded to the passenger. In such cases points registration is not automatic, therefore the passenger must send the relevant travel coupon of the airline ticket and the boarding card to Malév Duna Club in order to have the points credited.
IV/19. Bonus Points and Club Points are not awarded if a Bonus ticket is used. Bonus Points and Clubs Points shall not be awarded, or points may be credited up to a specified limit, on flights taken with discounted tickets offered within the Malév Duna Club Frequent Flyer Programme, at Malév's discretion, respectively depending on the terms of the promotion.
IV/20. Bonus Points and Club Points shall not be awarded on excess baggage charges paid on checked baggage exceeding the weight limit or on extra seats. Only the number of points accruable per one natural person shall be credited on one flight, irrespective of the number of seats purchased for the given person (extra seats, cabin, baggage etc.) on the flight.
V. Points balance, tier change, tier check
V/1. Points accrued within the framework of the Malév Duna Club Frequent Flyer Programme are registered in two accounts: the Bonus account and the Club account. The Bonus account is used to register Bonus Points, the Club account is used to register Club Points.
V/2. The Club account of the frequent flyer shall be automatically checked on 1 January of each year. The tier check is carried out with due consideration to the valid Club Points in the respective Club account in the previous 12 months.
Malév checks the membership tier of the frequent flier on 1 January of the second year following the day of entry, respectively the part year of the potential tier change. The year is considered a part year if the passenger enters the programme not on 1 January but during the course of the year, respectively if he/she enters a higher tier during the course of the year.
V/3. If prior to the tier check the Club Points of the frequent flyer reach the level required to enter the next tier, Malév shall automatically rank the frequent flyer in the higher tier and mail a new frequent flyer card to him/her.
V/4. If by the time of the tier check the passenger has not accrued the number of Club Points required to enter the next tier, but has sufficient Club Points to maintain his/her current tier, then he/she remains at the tier corresponding to the current membership tier. In this instance, Malév shall mail to his/her address a new Silver, Gold or Platinum Card corresponding to the current membership tier.
V/5. If the frequent flyer does not reach the number of Club Points required to maintain his/her current tier, irrespective of the number of Club Points accrued by the frequent flyer in the course of the given year, then he/she shall be moved to the next membership tier down, except where the current membership tier was Blue, in which case he/she maintains this tier even if the member did not accrue any Club Points up to the date of the tier check. In this instance, Malév shall mail to his/her address a new Blue, Silver or Gold Card corresponding to the lower membership tier.
V/6. Silver, Gold and Platinum frequent flyer cards are valid for 1 year. In the case of part years, the cards shall be valid for the last, completed, whole term of 12 months. Blue and Basic tier frequent flyer cards are valid for as long as the frequent flyer has valid membership of Malév Duna Club.
V/7. Malév shall not be held liable for delays or deficiencies occurring in the course of correspondence with Malév Duna Club members.
VI. Bonus Points purchase option
VI/1. Missing Bonus Points required to redeem a Bonus ticket for a scheduled Malév flight may be purchased, depending on the Malév Duna Club membership tier as follows:
- Basic tier maximum 4000 Bonus Points/trip
- Blue tier maximum 6000 Bonus Points/trip
- Silver tier maximum 6000 Bonus Points/trip
- Gold tier maximum 11000 Bonus Points/trip
- Platinum tier unlimited number of Bonus Points/trip
The abovementioned maximum quantities are also applicable even if two or more persons travel together on the same occasion using a Bonus ticket, that is, in this case too - irrespective of the number of persons travelling together - the opportunity to purchase Bonus Points is limited to the abovementioned maximum Bonus Points/trip in total.
VI/2. In addition to observing the limitations set down in point VI/1. above, the points purchase option is also restricted to the number of Bonus Points representing the difference between the points in the frequent flyer's Bonus account and the points required for the Bonus ticket(s). The purchase of Bonus Points not for immediate use, purely to credit a Bonus account, is strictly forbidden.
VI/3. Malév shall publish in a separate notice the Hungarian forint equivalent of purchasable Bonus Points, and shall reserve the right to change the point value at any time without prior notice.
VII. Using points
VII/1. a) Bonus balance
- The member shall be entitled to redeem points registered on the Bonus account for Bonus tickets and upgrade services as well as payment of the administrative fee connected to the Bonus ticket, furthermore to use them for purposes set down in Chapters IX. and X. of the current Regulation.
- Bonus Points used thus are deducted exclusively from the Bonus account; the Club balance does not change.
b) Club balance
- The number of points registered in the Club account determines the membership tier.
- Malév shall publish information on the services available in the different membership tiers in a separate notice.
VII/2. Bonus Points and Club Points shall not be exchanged for money or any other service, allowance or benefit not listed in the current Regulation, respectively in a separate notice published by Malév.
VIII. Bonus ticket (Bonus trip)
VIII/1. The Duna Club member shall be entitled, in exchange for his/her Bonus Points, to redeem a Bonus ticket for specific scheduled flights of Malév and its partner airlines, for himself/herself or for any other natural person designated by the member, which entitles the person named on the ticket to a Bonus trip.
VIII/2. The number of Bonus Points required to be redeemed for a Bonus ticket allowing a Bonus trip on scheduled flights of Malév and its partner airlines shall depend on the actual distance of the trip, the number of flight segments involved in the trip and the air ticket reservation class. Malév shall publish the number of Bonus Points necessary to redeem a Bonus ticket in a separate notice. Even in the instance where other conditions are in agreement, the number of Bonus Points necessary to redeem a Bonus ticket may differ from airline to airline.
VIII/3. The Malév Duna Club member shall be required to provide evidence of club membership and identify him/herself in order to receive a Bonus ticket as well as all other Malév Duna Club services. Identification is accomplished by presenting the frequent flyer card issued by Malév, or a certificate temporarily replacing such a card, as well as the Duna Club member's valid passport or his/her identity card (or photocopies of these documents).
VIII/4. In connection with the Bonus trip - and when taking advantage of Malév Duna Club services - the passenger(s) shall bear all additional costs that arise (for example, airport taxes, duties, security surcharges, other fees etc.).
VIII/5. Malév and its partner airlines reserve the right at all times to determine the number of seats open to reservations - in general or for specific flights or periodically - for Bonus trips of Malév Duna Club members, furthermore to restrict or suspend the availability of Bonus trips for certain flights or periods ("blackout dates"), irrespective of the number of seats available on a particular flight.
VIII/6. Seat reservations for Bonus trips may only be made at the Malév Service Center or at Malév's domestic and foreign offices. Bonus trip reservations made by any other method (for instance, through foreign or domestic travel offices, agencies) shall be invalid.
VIII/7. At the time of making a seat reservation for a Bonus trip, the Malév Duna Club member shall inform the person making the reservation that he/she requests a reservation for a Bonus trip. If this obligation is neglected, the reservation shall be invalid.
A reservation made for a flight paid or to be paid in cash cannot be changed to a reservation for a Bonus trip.
VIII/8. Airline tickets for Bonus trips shall be redeemed at least seven days prior to departure, and may be ordered one year prior to departure at the earliest. Since the number of seats for Bonus trips of a given flight may be limited, it is recommended that applications for reservations be made at least six weeks prior to the planned date of departure. No charge is applied for modifications to reservations prior to issuance of the Bonus ticket.
VIII/9. Frequent flyers holding Basic, Blue, Silver or Gold Malév Duna Club Cards are entitled to convert an issued Bonus ticket back to Bonus Points, to modify it or to have it reissued for another route, which is considered a ticket exchange, against payment of an administrative charge. Frequent flyers holding a Platinum Malév Duna Club Card shall be exempted from payment of the administrative charge in the above cases. The administrative charge for converting or modifying the Bonus ticket is 1500 Bonus Points, or the equivalent thereof in Hungarian Forints, which rate Malév publishes in a separate notice, and which is made available to Malév Duna Club members either on the website or by other appropriate means.
VIII/10. If the Bonus Points from which the Bonus ticket was issued expire - in part or fully - between issuance and modification of the Bonus ticket, then any modification to destination or name of passenger made prior to the trip shall result in forfeiture of the points that have expired in the interim; that is, the Bonus Points that expired in the interim may not be used for the issuance of another Bonus ticket, unless the only modification is to the date of travel.
VIII/11. Bonus tickets are valid for one year from the date of issuance of the air ticket.
VIII/12. Bonus tickets shall be issued exclusively with OK status, confirmed for all segments of the flight. This means that the ticket shall not contain a standby (RQ, WL) or OPEN segment.
VIII/13. Stolen or lost Bonus tickets shall not be replaced, modified, redeemed or refunded.
VIII/14. Inasmuch as a Bonus trip contains more than two segments and the booking classes are different for each coupon (economy and business/first, business and economy/first, first and economy/business), then the flight shall not be issued in a single ticket.
IX. Redeeming a Bonus ticket for a third party
IX/1. With the exception of conditions set down in Chapter X., Bonus Points are not transferable inter vivos.
IX/2. The provision in point IX./1. does not exclude a Malév Duna Club member - irrespective of membership tier - redeeming a Bonus ticket from Bonus Points on the Bonus account of the member in the name of any natural person (beneficiary) named by the member.
The frequent flyer shall make a statement to this effect formulated in a private document providing full evidence signed by two witnesses or countersigned by an attorney/notary. The declaration shall contain data of the frequent flyer certifying his/her Malév Duna Club membership, data suitable for the conclusive identification of the beneficiary/beneficiaries, passport or identity card number, furthermore the planned travel route and dates. In addition, the frequent flyer card, or a certificate temporarily replacing such a card, must be presented, and the Duna Club member's valid passport or his/her identity card (or photocopies of these documents) must be attached.
IX/3. The Malév Duna Club member shall not accept financial payment or any other form of counter-service from the person nominated on the Bonus ticket or from anyone else in exchange for the Bonus air ticket redeemed for the other party (beneficiary). The Malév Duna Club member expressly declares that he/she acknowledges and accepts that if he/she breaches the provision in the current point, this is qualified as unauthorized material gain which infringes the legal business interests of Malév to such a degree that it shall incur immediate and automatic termination of his/her Malév Duna Club membership on the basis of point XI./1.c) of the current Regulation.
IX/3. Apart from those benefits and services set down in the current Regulation, the beneficiary is due no other benefits and services.
X. Donation of Bonus Points to nonprofit organizations
X/1. The Malév Duna Club member may donate some or all of his/her Bonus Points available on the Bonus account - within the period of validity of the Bonus Points - to any of the nonprofit organizations supported by Malév. The nonprofit organizations are entitled to use donated Bonus Points to take advantage of Malév services in compliance with conditions set down in a separate agreement with Malév.
X/2. Information on the nonprofit organizations supported by Malév is available on the Malév website and through the Service Center. Bonus Points may be donated exclusively to those nonprofit organizations supported by Malév; it is not possible to donate Bonus Points to any other organization nominated by the member.
X/3. Acting on the basis of the written (including e-mail and fax correspondence) authorization of the Malév Duna Club member, Malév deducts donated Bonus Points from the member's Bonus account and transfers them to the Bonus account of the designated nonprofit organization, and then informs the nonprofit organization accordingly.
XI. Termination of membership
XI/1. The Malév Duna Club membership of a frequent flyer is terminated:
a) if the member, during the period of validity of the last credited Bonus Points, that is during 3 years, does not take advantage of any new service which would entitle him/her to Bonus Points crediting, or
b) if the member violates the Terms & Conditions of the Malév Duna Club Bonus Programme, or
c) if the member utilizes his/her Bonus Points for unauthorized material gain, or
d) if the member submits a written request for cancellation of membership, and at the same time returns his/her membership card to Malév Duna Club, or
e) on the death of the member.
If the Malév Duna Club membership is terminated due reasons defined in subsections b), c) and d) above, the total accrued Bonus Points and Club Points cannot be used in any form whatsoever as from the date of the termination of the legal membership relation, nor shall the former Malév Duna Club member have legal disposal over them.
XII. Other provisions
XII/1. The airline and commercial partners of the Malév Duna Club Frequent Flyer Programme fulfil the services provided to Malév Duna Club members in their own name and in accordance with their own prevailing contractual conditions. The frequent flyer has to enquire about these conditions himself/herself. Since these services are not supplied by Malév, Malév shall not bear any direct or indirect liability for their fulfilment.
XII/2. The airline or business partner providing services and their employees are entitled to deny the service if they have reasonable doubts as to the identity of the person requesting the service or as to his/her entitlement to receive the service.
XII/3. In the case of the death of a Malév Duna Club member, exclusively one heir (age 18 years or older) of the deceased may request - under the title of inheritance - transfer of the deceased's Bonus Points to the heir's own Malév Duna Club Bonus account. Bonus Points may only be inherited on the basis of proper official documents. Inasmuch as the heir is not yet a member of Malév Duna Club, a further precondition is submission of a fully completed Application Form to Malév in order to become a Malév Duna Club member.
Only Bonus Points can be inherited. Club Points and their tier and entitlement to the services of the tier cannot be inherited.
The term of validity of Bonus Points transferred through inheritance shall remain unchanged. The term of validity is not restarted because of the points transfer.
XII/4. Malév reserves the right to terminate the Malév Duna Club Frequent Flyer Programme by giving Duna Club members 90 days' preliminary notice of its intention.
XII/5. After the 90-day notice period, Bonus Points and Club Points shall not be accrued, and members shall have a further 180 days to use their remaining Bonus Points, irrespective of the validity of their frequent flyer cards.
XII/6. If the frequent flyer card of a Malév Duna Club member is lost or stolen, the holder is obliged to report such loss or theft to Malév within two days. Malév will take immediate steps to cancel the missing card. However, in the above instances Malév bears no liability whatsoever.
XII/7. In case of any dispute arising between a Malév Duna Club member and Malév, if they are unable to resolve such dispute through negotiations, the Central District Court of Pest (Pesti Központi Kerületi Bíróság) or the Metropolitan Court of Budapest (Fővárosi Bíróság) shall have exclusive competence, depending on the value of the case.
