Terms and Conditions of Malév`s Frequent Flyers Programme
Effective date: May 1, 2008
These Terms and Conditions of Malév`s Frequent Flyers Programme effective as of May 1, 2008, contain the text of the "Terms and Conditions of Malév`s Frequent Flyers Programme" issued on August 1, 2006 and on April 1, 2007 consolidated with the amendments entering into effect on May 1, 2008.
The Frequent Flyers Programme of Malév is established to reward loyal Malév passengers. The rights and obligations of participating in and the application of the programme are set forth by these Terms and Conditions of Malév`s Frequent Flyers Programme.
As of April 1, 2007, the provisions of Malév Plc.`s previous frequent flyer programme effective from August 1, 2006, shall be set aside and thereby these Terms and Conditions shall enter into force.
These Terms and Regulations shall remain in force until revocation.
Malév reserve its right to amend or derive from the terms of the issued regulation at any time, without being obligated to give preliminary notice to this effect.
I. The personal scope of application
I/1. Malév Duna Club shall accept as members
a) any natural persons aged 2 years or older,
b) who accepts the regulations of Duna Club, and
c) delivers his/her completed and signed Duna Club application form to the nearest Malév office,
d) or applies for the membership via web page of Malév Plc. (www.malev.com) by completing the online application form.
I/2. Malév shall send the frequent flyer's Duna Club identification code to the new member within 8 weeks subsequent to receiving the documents indicated in above paragraph.
I/3. Legal persons may not become members of the Malév Duna Club.
I/4. The scope and practice of applying the Duna Club Bonus Programme are provided for and restricted by the applicable international and national regulations of the competent authorities. Consequently, Malév shall not be liable for any legal or material breach of duty committed by Duna Club members.
I/5. The person completing the Duna Club application form shall conclude an agreement with Malév. In the agreement both parties shall declare that they consider the terms and regulations listed there, in particular the "Terms and Conditions of Malév`s Frequent Flyers Programme" binding.
I/6. Children between the age of 2-18 years (on the basis of a ticket purchased under child discount as well) may join the program as independent Duna Club members, their accounts may be credited with all Bonus and Club Points1 collectible on given flights and they shall pay the full number of Bonus Points for Bonus airline tickets.
Until the child reaches age 14, his/her legal representative shall decide regarding membership issues and on using Bonus Points. Between the age of 14 and 18 years, the valid declaration of the minor requires the consent or the ratification of the legal representative. Requests shall always be submitted in writing.
II. Acceptance of entry, authorization
II/1. The person intending to participate in the Bonus Programme, that is joining Duna Club, by delivering his/her completed application form expressly manifests, that he/she fully aware of the conditions and rules set forth by the application form and this regulation, considers those authoritative and accepts those. Registration is possible online via Malév Plc. web-page (www.malev.com), or in the form of signed writing by completing the Application form and sending it to the Malév Customer Service office.
II/2. The printed Application form sent to the Customer Service office becomes valid when it is signed. Unsigned application forms shall be invalid.
II/3. It is an obligation of the passenger to inform Malév Customer Service about changes of data indicated on the application form. Data modification can be communicated in the form of signed writing or via Malév Plc. web-side with the Malév Frequent Flyer card number.
II/4. By completing and signing the application form (and in case of online registration) the Duna Club member authorizes and grants his express consent to Malév Zrt. to verify the personal data disclosed on the application form.
II/5. Each member of Duna Club shall receive an individual frequent flyer identification code, which allows differentiating between them, even if the members bear corresponding names.
The personalized frequent flyer card, corresponding to the Duna Club membership tier2 shall indicate the name of the holder and the frequent flyer identification code; while the card of advanced tiers shall indicate the expiry date as well.
II/6. Each Duna Club member shall have only one frequent flyer identification code, data file and database at any one time; and under a given identification code, the Bonus and Club Points3 of one Duna Club member may be credited.
II/7. Frequent flyers of Blue, Silver, Gold and Platinum tiers shall receive a plastic frequent flyer card to prove their membership. Frequent flyers of Basic level shall receive a paper-based frequent flyer card, unless Malév and its business partners agree otherwise.
II/8. The Frequent flyer card issued to Duna Club members shall remain the property of Malév, which must be returned to the address of the Malév Customer Service without specific notice to this effect or must be destroyer, upon the termination of membership (the same rule applies to the previous card, upon receiving a new card issued when changing levels). The reclassified or repositioned member undertakes to return his/her used card to the Malév Duna Club office without specific notice to this effect or destroy that within 15 days of receiving notice on being repositioned.
II/9. The Duna Club member shall be entitled to authorize other natural persons of legal age to proceed on his/her behalf regarding Duna Club matters (e.g. take-over airline ticket) via a private document of conclusive force, or via an official document.
Private documents of conclusive force are as follows:
a) the issuer prepared and signed the documents;
b) two witnesses attest, by signing the document, that the issuer has signed the document written by a third party in their presence or acknowledged the signature in their presence as his/her own; the domicile (address) of the witnesses must be indicated in the document as well;
c) the signature or hand mark of the issuer is attested on the document by a judge or a notary public;
d) an attorney (legal counsel), by validly countersigning the document prepared by him/her, attests that that the issuer has signed the document in his/her presence; or acknowledged the signature in his/her presence as his/her own, or that the content of an electronic document signed by the qualified electronic signature of the issuer is corresponding to that of the electronic document prepared by the attorney;
e) the issuer of the electronic document has placed its qualified electronic signature on the electronic document.
II/10. Malév may exclusively manage the personal data provided by the Duna Club members under this chapter in connection with performing its services and pursuant to those stated in point II/4., as well as in compliance with the data-protection provisions of the applicable laws.
III. Duna Club tiers
III/1. The Duna Club program contains the below tiers:

III/2. Members of the Duna Club programme shall be admitted to the Blue, Silver, Gold, or Platinum tiers, depending on the number of valid Club Points4 collected, as indicated by the chart of the above point III/1. Malév, in the interest of the company, may derive from this provision.
III/3. Duna Club members without Club Points, shall be admitted to the Basic tier.
III/4. The member shall receive the services offered at the achieved Duna Club membership tier, until the expiry date of his/her frequent flyer card.
IV. Collecting and Crediting Points
The points of the registered Duna Club members shall be automatically credited if, at the time of booking the seat, collecting the ticket or during airport check-in, the frequent flyer presents his/her frequent flyer card or confirms his/her frequent flyer code. Malév shall bear no liability for failing to credit the points if the above conditions are not met.
Malév Plc. is entitled to decide that in case of certain airlines, flights or business partners only Bonus Points may be collected.
IV/1. The basic unit of Malév Duna Club Bonus Program is the Bonus Point and the Club Point.
- Bonus Points are valid for a 3-year term, commencing on the day of trip (rounded off for quarters).
- Club Points are valid for a 1-year term, commencing on the day, when the trip was credited for and shall be deleted at the end of the above period.
- Club Points may exclusively be collected on Malév flights and on scheduled flights operated by oneworld airlines.*
- Club Points shall not be collected after trips taken on flights of non-oneworld airlines or after receiving services provided by the business partners of Malév.
*oneworld member-airlines are: Iberia, Finnair, British Airways, Royal Jordan Airlines, American Airlines, Cathay Pacific, Japan Airlines, LAN Chile, Qantas.
Upon the expiry of the deadlines determined in this section, the relevant rights shall be forfeited
IV/2. The balances of the Bonus and Club Points may not be combined.
IV/3. The identical number of Bonus and Club Points shall be credited to the frequent flyer's account after a completed trip, with the exception of Bonus Point promotional events.
IV/4. The Bonus and Club Points shall be calculated pursuant to the below formula:

The number of the so-calculated points shall be credited to the account of the frequent flyer.
Bonus and Club Points of regular economy price, which are collectible at the Blue membership tier, are considered base points by Malév.
In case of frequent flyers at the Silver, Gold and Platinum tiers, the base points shall be multiplied by the tier multiplier, which is a multiplying factor corresponding to the different membership levels.

In the case of flying Business/Sky Club class or discount economy class of flights operated by Malév and its partner airlines, or First Class of the flights of partner airlines, the base points shall be multiplied by a multiplier corresponding to the given class, the class multiplier.

IV/5. Bonus Points may also be generated through special point-collection promotions advertised by Malév.
IV/6. Promotional points or points received on grounds other than travel, shall not be credited as Club Points; the above shall only be credited as Bonus Points.
IV/7. No tier multipliers will be applied on promotional Bonus Points and on Bonus Points credited on non-travel grounds.
IV/8. No points shall be credited after traveling on the flights of Malév or its partner airlines, or after the services of Malév business partners, if the points collectible on this basis were already credited to the passenger in the framework of another frequent flyer programme, or if the frequent flyer wishes to have those points credited later.
Points already credited in the Duna Club frequent flyer programme, shall not be retrospectively credited in the frequent flyer program of a partner airline.
IV/9A. Regarding the points credited on code share flights operated by Malév and its partners, the two-letter code indicated in the "Carrier" column of the passenger's ticket shall be applicable, unless Malév provides for otherwise.
IV/9B. In case of flying on code-share flights Bonus and Club Points shall be credited only if the flight is operated by a oneworld carrier and a oneworld airline code is indicated under the "Carrier" heading of the ticket. No Bonus and Club Points shall be credited in case of travelling on the flights of a oneworld member airline if such flights are not operated by a oneworld airline (but a third party), not even if a oneworld airline code is indicated under the „Carrier” heading of the ticket.
IV/10. Malév reserves the right to offer its frequent flyers additional benefits (beyond those established by this regulation) of promotional nature at anytime; to change the numbers of the charts indicating the points accruable on flights or the points required for Bonus tickets, or the tier multipliers.
IV/11. Based on their mutual decision, Malév and its airline- or business partners may offer options to collect extra Bonus Points for promotional purposes.
IV/12. Malév reserves the right to replace the current point system with a mile-based system.
IV/13. Bonus Points and Club Points shall be also credited after trips taken on Malév charter flights, where the MA code is indicated under the "Carrier" heading of the ticket. In case of trips taken on Malév charter flights, the Bonus and Club points accruable after trips taken on discount economy class shall be credited to the account of the passenger, irrespective of the actual class of the trip.
IV/14. If the Duna Club member finds that his/her Bonus Points have been miscalculated or have not been registered at all, the member can request in writing that the points be credited retroactively. Such request shall be sent to the Malév Customer Service Center by mail, fax, e-mail or in person, accompanied by the airline ticket and boarding card(s) of the flight in question; in the case of commercial partners, by submitting the other documents specified separately, under the applicable conditions or via the Malév website page designated for this purpose, under the applicable conditions. Points may be credited retroactively within 1 year commencing on the day of the flight. Malév Duna Club shall credit the Bonus Points retroactively within six weeks of receiving of the written request and the above-mentioned documents.
IV/15. Bonus and Club Points may only be credited on tickets actually used. No points shall be credited on the basis of tickets purchased, but not used.
IV/16. In case of trips registered retroactively, the validity of the Bonus Points shall be counted from the date of the flight; while the validity of Club Points shall be counted from the date of crediting the points.
IV/17. Points shall be credited retroactively within 1 year following the flight, the latest. The expiry of the above deadline results in forfeiting right, which shall not be excused.
IV/18. Bonus and Club Points shall not be credited if due to circumstances beyond the airline's control (especially, but not limited to strikes, weather conditions, any reason connected to air traffic control, technical problems etc.) or due to security consideration the flight is cancelled and/or the passenger uses his/her ticket on the flight of another airline. If the passenger is forced to travel on a route different from the one indicated by the ticket and/or on the flight of another airline, due to the fault of Malév (cancellation, overbooking etc.), then points for the original route as appearing on the original ticket may be awarded to the passenger. In such cases the point registration is not automatic, thus the passenger must send the travel coupon of the given airline ticket and boarding card to Malév Duna Club for having the points credited.
IV/19. No Bonus or Club Points shall be collected if a bonus ticket is used. If discount tickets (offered by the Duna Club program) are used, depending on Malév`s discretion or the promotion concerned, no Bonus or Clubs points shall be collected or points may only be credited up to a certain limit.
IV/20. Points shall not be credited on excess fees paid on overweight checked baggage or on extra seats. On the basis of one flight only the number of points accruable per one natural person shall be credited, irrespective of the number of seats purchased for the given person (extra seats, cabin, baggage etc.).
V. Point balance, change of tiers, tier check
V/1. Points are credited to two accounts: the Bonus Account and the Club Account. The Bonus Account is used to register Bonus Points, the Club Account is to register Club Points.
a) Bonus Account
- The points registered on the Bonus Account may be redeemed for Bonus tickets, upgrade services, or may be used for paying the administrative fees connected to the Bonus tickets.
- The points redeemed for a Bonus ticket shall be deducted from the Bonus Account.
b) Club Account
- The number of points registered on the Club Account shall determine the frequent flyer tier of the passenger.
- Malév shall not deduct those points from the Club Account, which were redeemed for Bonus tickets, upgrade services or used as payment for administrative charges.
V/2. Tier Check
Malév shall automatically check the Club Account of the frequent flyer on January 1, of each year. The tier check is carried out by considering the valid Club Points credited to the respective Club Account in the previous 12 months. Malév checks the membership tier of the frequent flier on January 1, of the second year following the day of entry or the fragment year of the potential tier change. The year is a fragment year is, if the passenger enters the program or if he/she enters a higher tier in the course of year (not as of January 1.)
V/3. If prior to the tier check the Club Points of a frequent flyer reach the level required to enter the next tier, Malév shall automatically send a card corresponding to the new tier.
V/4. If prior to the tier check the passenger has not accrued the number of Club Points which is required to enter the next tier, but has sufficient Club Points to maintain his/her current tier, then he/she remains at the tier corresponding to the current Card. In this case, Malév shall send to his/her address a new Card corresponding to the current membership tier of the passenger.
V/5. If the frequent flyer does not reach the number of Club Points required to maintain his/her current tier, then he/she shall be moved to the membership tier one below. The member may only be demoted by one tier at a time. Duna Club members of the Blue tier, who do not accrue Club Points prior to the tier check, shall not be demoted to the Basic tier.
V/6. The Silver, Gold and Platinum frequent flyer cards shall be valid for 1 year. In the case of fragment years, the cards shall be valid for the last, completed, whole term of 12 months. The Blue and Basic tier frequent flyer cards shall be valid for an unlimited period of time.
V/7. Malév shall send point-balances to the e-mail addresses or its registered Duna Club members as indicated on the application form.
V/8. Malév shall not be liable for delays or deficiencies occurring in the course of corresponding with the Duna Club members.
VI. Transferring Bonus tickets to third parties
VI/1. Bonus Points may not be transferred independently, only bonus tickets may be issued for third parties in exchange for the points required for a complete trip, in accordance with the provisions this regulation.
VI/2. Bonus tickets may be issued for any natural person, irrespective of his/her Duna Club tier, in exchange for reducing the number of the accrued Bonus Points by the number of points required for a complete trip, via a written waiver contained by a private document of conclusive effect, signed by two witnesses or countersigned by a lawyer/notary public.
VI/3. In the case of the death of a Duna Club member, exclusively one heir (age 18 or older) of the deceased may request that the Duna Club membership be continued, and the registered Bonus Points of the deceased's frequent flyer database be transferred to the heir's Bonus Account. Bonus Points may only be inherited on the basis of proper official documents. As a precondition of inheriting the points, the heir must acknowledge the content of this regulation and submit an application form described above to Malév.
Rights to Club Points, card tier and the services of the tier cannot be inherited. Bonus Points shall not be transferred to more than one individual. Bonus Points transferred through inheritance shall be valid for 36 months from the date of the original trip. Upon the expiry of the above deadline the right shall be forfeited, the delay may not be excused.
VI./4. Apart from the Bonus ticket issued in exchange for Bonus Points, no other benefits associated with the Duna Club membership may be transferred. The passenger holding a Bonus ticket transferred to him/her, shall not receive other benefits or services besides those described in the Duna Club operational regulations.
VII. Bonus Point Purchase Option
VII/1. The missing Bonus Points required to take a bonus trip on a scheduled Malév flight may be purchased, depending on the Duna Club membership tier:
Basic: 4.000 Bonus Points
Blue: 6.000 Bonus Points
Silver: 6.000 Bonus Points
Gold: 11.000 Bonus Points
Platinum: unlimited Bonus Points
VII/2. Malév shall establish the Hungarian forint equivalent of the purchasable Bonus Points, and shall reserve the right to change the point value at any time.
VII/3. The purchased Bonus points shall not be credited by Malév on the account of the frequent flyer.
VIII. Using points
VIII/1. Duna Club members shall be entitled to use their accrued Bonus Points for their own Bonus trips, for upgrade services or for paying administrative charges connected to the Bonus ticket. The members shall also be entitled to transfer the Bonus Points to natural person third parties, in the form of complete Bonus tickets, according to provisions of the above Chapter VI.
VIII/2. The number of points required for a Bonus trip on scheduled flights of Malév and on the partner airlines selected by Malév (as indicated on the official website of Malév) shall depend on the actual distance of the trip, the actual airline company, the number of the actual flight segment(s) and the actual flight class.
VIII/3. The Duna Club Bonus Points and Club Points shall not be exchanged for money or any other service, benefit, or property not listed herein.
VIII/4. The Bonus Points collected may only be used in accordance with the Frequent Flyer Terms and Conditions of Malév.
IX. Termination of Membership
Malév shall terminate the Duna Club membership if the Duna Club member:
a) violates the Terms and Conditions of the Duna Club Bonus Programme, or
b) utilizes his/her Bonus Points for gaining illegal financial advantage, or
c) submits a written request to cancel the membership, and at the same time returns his/her membership card to Duna Club.
If the Duna Club membership is terminated due reasons defined in subsections a), b) and c) above, the accrued Bonus and Club Points shall no longer be used or transferred in any form or shall not be inherited.
X. Bonus trip
X/1. The Duna Club member in possession of sufficient Bonus Points shall be entitled, in exchange for Bonus Points, to travel with the Bonus ticket on specific scheduled flights of Malév and its partner airlines selected by Malév (as indicated on the official website of Malév) and with due consideration to the relevant restrictions, to allow third parties to travel with the Bonus ticket.
X/2. The Duna Club member shall be obligated to identify him/herself in order to receive the Bonus ticket, just like in the case of other Duna Club services. Identification is accomplished by presenting the frequent flyer card issued and sent out by Malév, or a certificate temporarily replacing such a card, as well as the Duna Club member's valid passport (or a photocopy of this document) or his/her identification card.
X/3. The Bonus ticket may be transferred (in addition to having the required number of Bonus Points) if a "Waiver" of the Duna Club member - as described in section VI/2. of this regulation - is submitted, together with the frequent flyer card proving Duna Club membership, or any other certificate temporarily replacing the card as well as the Duna Club member's valid passport, a photocopy thereof or his identification card. The Waiver shall include the data verifying the Duna Club membership, the data of the beneficiary/beneficiaries suitable for clear and unambiguous identification, the passport number, and the route and dates of the planned trip
X/4. In connection with the Bonus trip - upon receiving Duna Club services - the passenger(s)/customer(s) shall bear all additional costs (e.g. airport taxes, duties, insurance charges, other fees etc.) with the exception of the fee the ticket-check.
X/5. Malév and its partner airlines reserve the right at all times to determine the number of seats open to reservations - in general or for certain flights or periodically - for Bonus trips available to Duna Club members, or to restrict or suspend the availability of Bonus trips for certain flights or periods ("blackout dates"), irrespective of the number of available seats on a particular flight.
X/6. Seat reservations for Bonus trips may only be made at the Malév Customer Service Center, at Malév's domestic and foreign offices or in the Malév Call Centers. Bonus trip reservations made by any other method (e.g. through foreign or domestic travel offices, agencies) shall be invalid.
X/7. At the time of making a seat reservation for a Bonus trip, Duna Club members shall inform the person making the reservation that he / she requests a reservation for a Bonus trip. If this obligation is neglected, the reservation shall be invalid.
A reservation made for a paid flight cannot be changed to a reservation for a Bonus trip!
X/8. Airline tickets for Bonus trips shall be ordered at least seven days prior to departure, and may be ordered one year prior to departure at the earliest. Since the number of seats for Bonus trips are limited, it is recommended that applications for reservations should be made at least six weeks prior to departure. No charge is applied for changing the reservations prior to the issue of the Bonus ticket.
X/9. Frequent flyers holding Basic, Blue, Silver or Gold Duna Club cards shall be entitled to convert the issued Bonus ticket to Bonus Points, to modify that or have that reissued for another route, (which is considered ticket exchange) if they pay the administrative charge. Frequent flyers holding Platina Duna Club Card shall be exempted from paying the administrative charge in the above cases.
The administrative charge of converting or reissuing the Bonus ticket is 1500 Bonus Points, or the equivalent thereof in Hungarian Forints, which is communicated to Duna Club members (on the website, or by any other proper means).
X/10. If the Bonus Points from which the Bonus ticket was issued partly or fully expire between issuing and modifying the Bonus ticket, then any destination or passenger-name modification made prior to the trip shall result in forfeiting the points expired in the interim; in other words, the Bonus Points expired in the interim may not be used for the issuance of other Bonus tickets, unless merely the date is modified.
X/11. Bonus tickets are valid for one year from the date of issue.
X/12. Bonus tickets may only be issued with OK status, confirmed for all segments of the flight. This means that the ticket shall not contain a standby (RQ, WL) or OPEN segment.
X/13. Stolen or lost Bonus tickets shall not be replaced, modified, redeemed or refunded.
X/14. If the Bonus trip contains more than two segments and the booking classes are differing, based on the coupons (economy and business/first, business and economy/first, first and economy/business), then the flight shall not be issued in one ticket.
XI. Other Benefits
XI/1. The Duna Club member shall be entitled to receive the services determined by his/her Club membership tier.
XI/2. Duna Club airlines and business partners shall exclusively be responsible for providing the services offered / rendered by them as third parties; Malév shall bear no liability in this respect, that is Malév does not undertake any direct or indirect liability or warranty in connection with the above services. Duna Club members may exclusively contact the airline or business partners with their claims. Pursuant to the agreements concluded with Malév the business partners generally reserve their rights to amend the terms not regulated by contracts without prior notification. Malév shall not be liable for the content of the frequent flyer programs of other airlines, or any change thereto.
XI/3. The airline or business partners providing services and their employees are entitled to deny the service, if they have reasonable doubts as to the identity of the person requesting the service or as to his/her entitlement to receive the service
XI/4. All information relevant to Duna Club, such as the full text of this regulation shall be available and accessible via Internet through the official website of Malév.
Malév reserves the right the change this regulation, any of the benefits and services offered by it without prior notice. Malév will publish the possible modifications on its official website.
XI/5. Malév and its airline or business partners by mutual resolution shall be entitled to change any of the benefits and services offered by them without any prior notice. Malév will publish the possible modifications on its official website.
XII. Supplementary terms
XII/1. Malév reserves the right to terminate the Bonus Programme by giving the Duna Club members a 90 days preliminary notice on its intention.
XII/2. After the 90-day notice period, Bonus and Club Points shall not be accrued, and the members shall have further 180 days to use their remaining Bonus Points, irrespective of the validity of their frequent flyer cards.
XII/3. If the frequent flyer card of a Duna Club member is lost or stolen, the holder is obliged to report such loss or theft to Malév within two days. The Malév Duna Club Frequent Flyer Service Center will immediately take steps to put hold on the missing card. However, in the above instances Malév bears no liability whatsoever.
XII/4. Any miscellaneous terms of services provided by Malév's business partners and any further conditions concerning the collection of the points may be subject to further special provisions. Malév shall inform Duna Club Members of such conditions via its website and/or in newsletters and/or in another manner.
XII/4. To matters not regulated herein, the provisions of Malév's Code of Business and the relevant and effective Hungarian laws shall be applicable.
XII/5. In case of any dispute arising between Duna Club members and Malév, if they are unable to resolve such dispute through negotiations, the Central District Court of Pest (Pesti Központi Kerületi Bíróság) or the Metropolitan Court of Budapest (Fővárosi Bíróság) shall have exclusive competence, depending on the value of the case. The provisions set forth herein shall govern the legal relationship between the Duna Club members and Malév.
XII/6. Upon these Terms and Conditions of Malév Frequent Flyer Programme entering into force on May 01, 2008 the "Terms and Conditions of Malév Frequent Flyer Programme" issued on Apr 1, 2007 shall become null and void.
